Prosecution claims Corona fails to support testimony

HOUSE impeachment prosecutors are confident of getting a conviction come Tuesday from senator-judges after Chief Justice Renato Corona failed to present documentary evidence to support his oral testimony.
“There has been no degree of demolition. In fact, it (Corona’s testimony) has only strengthened our case,” House Deputy Majority Leader Miro Quimbo, a spokesperson for the prosecution team, said in a press conference.
“The prosecution believes that the testimony of the Chief is essentially inadmissible in evidence, and even if the testimony is admitted, it has very little evidentiary value, if any,” lead private prosecutor Mario Bautista earlier told the impeachment tribunal.
Corona faced the impeachment tribunal on Tuesday, May 22, and delivered a three-hour narrative testimony before he excused himself from the court after supposedly suffering from hypoglycemia.
He returned on Friday, May 25, to answer clarificatory questions from senator-judges after both the defense and prosecution panels chose not to conduct the direct and cross examinations.
In answering clarificatory questions, Corona admitted before the court that he has $2.4 million and P80 million in dollar and peso accounts.
The chief magistrate cited a provision in the Foreign Currency Deposit Act which guarantees absolute confidentiality on deposits as his excuse for not declaring the $2.4 million in his statements of assets, liabilities and net worth (SALN). He also said the P80-million funds in his peso accounts were commingled; therefore, not necessary to be declared in his SALNs.
He is accused of betrayal of public trust and culpable violation of the Constitution for failing to truthfully filing his SALNs since he became a member of the Supreme Court in 2002.
Spokespersons for the prosecution said Corona could have easily showed documents that would prove his “hearsay” and “self-serving” statements.
“He did not even show a single deposit or trust agreement,” Quimbo noted.
Aurora Representative Sonny Angara, another prosecution spokesperson, doubted that Corona’s testimony would be easily bought by the senator-judges.
“We have presented the AMLC (Anti-Money Laundering Council) report, the Ombudsman, SALNs, bank records, etc.,” Angara said.
Referring to the AMLC report, Ombudsman Conchita Carpio-Morales earlier said that Corona has 82 dollar accounts, deposits of which amount to at least $10 million.
Spokesperson and House Deputy Speaker Erin Tanada added that there was no excuse for the Chief Justice not to declare his peso accounts even if funds were commingled. Corona claimed that almost half of the P80-million funds were of his wife’s family corporation, the Basa Guidote Enterprises Inc.
“What’s wrong with declaring commingled funds? There’s no excuse for that,” Tanada said.
The Senate impeachment tribunal will hand down its verdict at the earliest on Monday after the oral arguments of the defense and prosecution panels.
