Palace shrugs off Aquino critics
MALACAÑANG defended President Benigno Aquino III against criticisms that he may be getting bad legal counsel that led to his brushes with the Supreme Court over the case of his predecessor, Pampanga Representative Gloria Macapagal-Arroyo.
Deputy presidential spokesperson Abigail Valte, in a briefing over government-owned Radyo ng Bayan, said Malacañang has already explained why it barred former President Arroyo from leaving the country last month.
The Supreme Court had issued an order to prevent the Department of Justice from putting the former President on a travel watch list but Justice Secretary Leila de Lima said the court order was not yet executory at the time.
Representative Arroyo was arrested for electoral sabotage within days of the standoff. At the time the Supreme Court issued the injunction, there were no formal charges against her. She and her husband, Jose Miguel, said the watch list order violated their right to travel.
But de Lima denied the request citing inconsistencies in the documents included in Arroyo’s travel request and a lack of an “urgent” need for her to seek treatment abroad for hypoparathyroidism and a mineral bone disease.
“We do not see the need to reiterate anymore especially to someone who is so set in his ways that (he) really does not take any explanation,” she said.
Senator Joker Arroyo said Sunday that President Aquino is “in effect” doing the same thing that former President Ferdinand Marcos Jr. did during Martial Law.
In an interview on dzBB, Senator Arroyo said the Aquino administration is defying a constitutional prohibition on inhumane and degrading punishment in its treatment of Representative Arroyo, who has been charged with engaging in electoral sabotage while she was President.
Senator Arroyo said the “full force of the government” was used to keep the Pampanga lawmaker to keep her from leaving and to charge her in court.
“Isn’t that inhumane and degrading? That’s not allowed by the Constitution,” he said.
He said the Department of Justice should not use the argument that the government’s rights supersede the rights of the individual.
“That was the excuse for Martial Law. That is the defense of Marcos,” he said.
He said, however, that the President’s legal advisers are to blame.
Aquino, last week, told the Manila Business Club that he has hound the Supreme Court’s decisions “puzzling” and “alarming”.
“You cannot blame (the President) for his remarks because he is not a lawyer,” Senator Arroyo said, adding that is what legal advisers are for.
The senator also said the government cannot be selective with justice by fast-tracking the electoral sabotage case while prosecution of suspects in the Maguindanao massacre has been plodding along.
He added the administration and its allies cannot cite Supreme Court Chief Justice Renato Corona’s ties with the former President to urge him to inhibit from Arroyo cases or threaten to impeach him.
Critics of Representative Arroyo have said Corona is biased for the former President because she appointed him as chief justice.
But Senator Arroyo said late President Corazon Aquino herself appointed the entire post Marcos Supreme Court but the Marcoses, “the cronies, and the military” did not complain “because there was already a new Constitution.”
The senator added it was unfair that Aquino and his allies can criticize the Supreme Court but are quick to label their critics as puppets and cronies of the former President.
“Is that how we do things now?” Senator Arroyo said.
Senator Miriam Defensor-Santiago, who also came out last week to defend the Supreme Court, said pressuring Corona to inhibit himself from Arroyo cases sets a dangerous precedent because it lets people choose which judges hear which cases. (Jonathan de Santos/Sunnex)
