Oral arguments for Boracay reclamation project set

GROUPS and individuals disputing a reclamation project in Boracay will be allowed to air their sentiments after the Supreme Court (SC) set oral arguments on the case on September 13.
The SC agreed to hold oral arguments on that date “to enable the parties…to amplify their positions on the issue presented before the Court,” Court spokesperson Midas Marquez said.
However, the court’s decision to allow oral arguments does not mean that it has lifted the temporary environmental protection order (Tepo) it issued against the project.
The Tepo, which prevents the project from being implemented, remains in effect until further order from the court, said Marquez.
Earlier, the Boracay Foundation Inc., composed of at least 60 resort, hotel, and restaurant owners, including community organizations and environmental advocates asked the High Court to suspend the project.
The group said that a comprehensive environmental impact assessment and a series of public hearings should be held before the project should be allowed to proceed.
Named as respondents in the petition are the province of Aklan, represented by Gov. Carlito Marquez; the Philippine Reclamation Authority; and the Environmental Management Bureau of the Department of Environment and Natural Resources.
The petition stemmed after the respondents started implementing Phase 1 of the reclamation project last December 6, 2010.
The project’s first phase covers the Caticlan side, which is supposedly a mere “rehabilitation” of the existing Jetty Port that serves as the gateway from mainland Aklan to Boracay, and is separated only by a narrow strait of water.
The second phase covers some 3.18 hectares of the main Boracay Island.
The BFI also questioned as to why the Aklan provincial government had been issued with an Environmental Compliance Certificate despite lacking the required local clearances and permits from Barangay Caticlan and the Malay Municipality. (AMN/Sunnex)
