No need for bank waiver from next Chief Justice: Tupas

A MEMBER of the Judicial and Bar Council (JBC) sees no need for the next Chief Justice to sign a waiver on bank accounts.

However, Iloilo Representative Niel Tupas Jr., a member of JBC, said the next head of the Supreme Court should be truthful in the declaration of his assets and net worth.
“No need (for bank waiver). What he or she should do is to be honest and truthful in his SALN (statement of assets, liabilities and net worth),” Tupas said in a text message.
Tupas, one of the prosecutors in the impeachment trial of deposed Chief Justice Renato Corona, is one of the three ex officio members of JBC, which has the constitutional mandate to come up with a shortlist of candidates for the vacant positions in the judiciary.
Two other council members are Justice Secretary Leila de Lima and Senator Francis Escudero.
With a majority vote of the 23-member Senate, Corona was found guilty of betrayal of public trust and culpable violation of the Constitution for his failure to truthfully declare his SALNs.
In one trial day where Corona sat in the witness stand, the former Supreme Court chief signed a waiver allowing banks to disclose his accounts. Corona said he has $2.4 million in four dollar accounts and P80.7 million in commingled funds in peso accounts.

Tupas, meanwhile, said the JBC will observe a strict screening process for the next Chief Justice.

“I’m not particular whether insider or outsider as long as he is a person of proven competence, integrity, probity, and independence,” Tupas said in answering question whether he is amenable for an outsider getting the post.

Deputy presidential spokesperson Abigail Valte said President Benigno Aquino III is open to selecting an outsider to replace Corona but stressed that Aquino will still rely on the shortlist of nominees to be provided by the JBC.

Being the most senior magistrate, Supreme Court Associate Justice Antonio Carpio was appointed as the acting Chief Justice. Carpio was Corona’s fiercest rival to the post two years ago.

Bagong Henerasyon party-list Representative Bernadette Herrera-Dy, meanwhile, suggested naming one of three lady justices in the SC as the next chief justice.

Herrera-Dy said the appointment of anyone among the three female associate justices in the High Court will go down in the country’s judicial history as a first since all 23 chief justices that occupied the position first held by the late Chief Justice Cayetano Arellano in 1901 were all males.
“Naming a woman SC chief justice can be a vital part in the Aquino judiciary reform agenda because it will erase wrong notions against gender equality in the High Court,” she added.
The batch of SC woman justices includes Associate Justices Teresita Leonardo De Castro, Ma. Lourdes Sereno, and Estela Perlas-Bernabe.
