Mayor supports cities’ league move vs SC justices

ANGELES CITY – Mayor Edgardo Pamintuan is supporting the cities’ league plan to file impeachment complaints against justices of the Supreme Court, who voted to uphold conversion 16 municipalities.
Pamintuan, public relations officer of the League of Cities of the Philippines (LCP), said the 16 municipalities failed to meet the cityhood requirements under the Local Government Code.
“It is frustrating that the Supreme Court committed another judicial error of recognizing unqualified municipalities as cities,” Pamintuan said.
He added that the rule of law was compromised again on the recent decision of the High Court, junking the motion for reconsideration filed by LCP against the conversion of the 16 municipalities into cities.
“We do not mind if our internal revenue allotment (IRA) is reduced, as long as these towns follow the legal requirements and uphold the rule of law.” Pamintuan stressed.
The mayor added that other municipalities, like the neighboring towns of Mabalacat, deserve to be converted, but not the 16 municipalities who seemingly use “short-cuts” toward cityhood.
Under Section 10, Article 10 of the Philippine Constitution, “No province, city, municipality, or barangay may be created, divided, merged, abolished, or its boundary substantially altered, except in accordance with the criteria established in the local government code.”
The local government code, as amended by Republic Act 9009 that took effect on June 30, 2007, provides that a municipality may be converted into a component city only if it meets two of three requirements: “locally generated average annual income of P100 million for the last two consecutive years and contiguous territory of at least 100 square kilometers or a population of not less than 150,000 inhabitants.”
All the 16 new cities failed to meet the P100-million income requirement, the LCP reported.(Reynaldo Navales)
