Justice: Aquino government ‘exceeded boundaries of propriety’

WITHOUT mentioning names, Supreme Court Associate Justice Lucas Bersamin turned the tables on President Benigno Aquino III, saying his administration disobeyed its recent rulings.
Speaking at the Grand Alumni Homecoming of the University of the East Law School last November 24, Bersamin said that the Justices are just doing their job under the Constitution to interpret the country’s laws.
“When unreasonable resenters and skeptics exceed the boundaries of propriety and orderliness, they directly threaten the institution of the courts. The principles of free government are then publicly scorned and perverted. The reputation of the courts is disparaged,” he said.
Bersamin, an appointee of ex-President Gloria Macapagal Arroyo, made these remarks after Aquino publicly chastised members of the Supreme Court, including Chief Justice Renato Corona, for its rulings seen to have favored the current Pampanga Representative.
Last November 15, Justice Secretary Leila de Lima ordered immigration officers to keep former President Gloria Macapagal-Arroyo from leaving the country while under criminal investigation for poll sabotage and plunder cases.
De Lima’s instructions were complied with despite a travel clearance issued by the High Court that allowed Arroyo to leave. However, De Lima said the Supreme Court’s ruling cannot be implemented since they have yet to receive a copy of the restraining order on the watchlist issued against Arroyo.
De Lima has since forwarded her explanation to the justices on the matter as she maintained that Arroyo is a flight risk.
Arroyo is currently under hospital arrest for sabotaging the results of the 2007 senatorial elections.
Somewhat irked by the government’s hostility toward the High Court packed with Arroyo appointees, Bersamin advised lawyers who joined in undermining the courts to surrender their licenses.
“This is because you would thereby assault the Judiciary of which you are an important officer and thus its integral part and parcel. You will have become unworthy of your Lawyer’s Oath,” he said.
Bersamin also said that they cannot engage in verbal tussle because magistrates are known by their writings and not by debates and slanders.
Chief Justice Renato Corona had the same line of reasoning last October 13, when he told a gathering of judges about the criticisms they drew from various sectors, particularly Malacañang.
“Never before has the entire judiciary, even in the days of martial law, been subjected to so much disrespect and lack of civility from sectors we sincerely consider to be our partners in nation-building,” he said.
Nearly two months later on December 5, it was Aquino’s turn to deliver strong remarks against the SC for upholding Corona’s alleged midnight appointment last year and for blocking attempts to hold past government officials accountable.
