High Court junks raps vs Corona

THE Supreme Court (SC) dismissed Tuesday for being moot the administrative complaint against ousted Chief Justice Renato Corona over charges of accepting bribe from a gaming corporation in a form of airline tickets to Las Vegas in May 2009.
In a three-page per curiam resolution, the Court en banc found no merit in the complaint filed by lawyer Fernando Campos, chairman of the Inter-Petal Recreational Corp. who filed the complaint against Corona during his incumbency as Chief Justice.
Campos’s company, whose clientele includes cockfighting aficionados abroad, is engaged in online gaming.
One of the allegations in the impeachment complaint against Corona was his unfavorable decision on the petition filed by Inter-Petal, though this was later on dropped by House prosecutors as they concentrated on just three articles of impeachment, among them, the justice’s failure to declare his peso and dollar deposits in his statement of assets, liabilities and net worth (SALN), for which he was convicted and removed from office.
“Considering the judgment dated May 29, 2012 of the Senate sitting as an impeachment court, which found Corona guilty of the charge under Article II of the Articles of Impeachment, with the penalty of removal from office and disqualification to hold any office under the Republic of the Philippines…, the complaint against (Corona) dated September 14, 2011 filed by Inter-Petal is hereby dismissed for having become moot and academic,” the Court ruled.
All 14 magistrates of the SC concurred with the per curiam decision, led by acting Chief Justice Antonio Carpio.
In his complaint, Campos asked the SC to mount a formal investigation on Corona for allegedly committing unethical behavior unbecoming of a magistrate by meeting the legal counsel of the opposing party.
Corona penned the decision and chaired the SC First Division that had jurisdiction over the case filed by Campos against the Securities and Exchange Commission, Pagcor and Philweb Corp. in connection with the operation of an online cockfight betting.
Campos had accused Corona of impropriety and undue haste in dismissing his petition allegedly in exchange for accepting bribe from the other party in the form of free airline tickets to Las Vegas on May 3, 2009 to watch the Manny Pacquiao-Ricky Hatton fight.
He said his petition was dismissed even with the preponderance of evidence showing conspiracy among respondents SEC, Pagcor and Philweb.

The First Division dismissed Inter-Petal’s petition charging SEC with grave abuse of discretion for denying it has jurisdiction over Pagcor and Philweb after it allegedly made false disclosure of the sale of Philweb shares at the Philippine Exchange over E-Games, including Tele-Sabong of the complainant.
This issue was also raised by Campos when Corona made a successful bid for the position of chief justice.
