Disbarment case filed vs Justice chief

MANILA (Updated) — Justice Secretary Leila de Lima’s license as a lawyer should be revoked for openly defying the Supreme Court’s order that allowed former President Gloria Macapagal-Arroyo to seek medical treatment abroad, a concerned lawyer said.
Lawyer Ricardo Rivera, who filed a disbarment case against de Lima at the High Court on Monday, said the Justice chief’s actions constitute a clear violation of the Court’s order.
“Respondent’s conduct, as herein discussed, falls short of the exacting standards expected of her as a vanguard of the legal profession. She has displayed a conduct that is most disgusting and with so much arrogance unbecoming of an officer of the court,” an excerpt of Rivera’s nine-page petition read.
Rivera, who maintains the Rivera Law Office in Jollibee Plaza condominium in Ortigas, Pasig City, said in a text message that he was never connected with the Arroyos.
Earlier, the government — through de Lima — refused to recognize the travel clearance pending receipt of the order as she tasked immigration officers to bar Arroyo and her party from boarding a Hong Kong-bound plane.
De Lima had said she is ready to face the charges head on, although she declined to tag the Arroyo camp as responsible for this complaint.
“I know who is behind this complaint against me. I am not afraid. I am simply doing my mandate,” she said.
In other developments, de Lima maintained that she should not be cited in contempt because the executive has yet to receive a copy of the temporary restraining order against the watchlist and that they will appeal the decision.
The appeal was junked by the High Court on November 18, only to be superseded by the issuance of a warrant of arrest by a Pasay City court after Arroyo was charged with poll sabotage in connection with the 2007 senatorial elections.
“How is service to the party or person sought to be enjoined effected? Is it effected by mere media announcement or press conference, as so ably suggested by legal experts who have sprouted all over in the course of two weeks’ time? (The) respondent does not think so…,” she told the Court in response to the justices’ order to explain why she failed to implement the travel clearance.

Still, Rivera said de Lima’s actions were unacceptable.
“The TRO was widely circulated and a copy was brought to the airport where her watchlist order was to be enforced,” he told Sun.Star in a text message.
Section 27, Rule 138 of the Rules of Court states that a lawyer can be disbarred or suspended for any “deceit, malpractice, or other gross misconduct in such office…or for a willful disobedience of any lawful order of a superior court.”
To carry out the case, Rivera asked the High Court to suspend de Lima’s license and order the Integrated Bar of the Philippines to hold disbarment proceedings.
After the hearings, Rivera said the justices should move to disbar de Lima, who has been practicing law since 1985.
If found guilty of indirect contempt, de Lima will be slapped with a fine of up to P30,000 or imprisonment of up to six months, or both, according to the Rules of Court. (Virgil Lopez/Sunnex)
