Court clerk prompted to submit Corona SALN to Senate

SUPREME Court clerk Enriquetta Vidal was brought near to tears Wednesday afternoon as the Senate, as an impeachment court, ordered her to submit Chief Justice Renato Corona’s asset disclosure documents.
She had asked for time to seek authorization from the Supreme Court but could not buck the ruling by Senate President Juan Ponce Enrile.
“I am really in a dilemma,” she said. She had repeatedly told the court that she did not have the authority to release the documents. She said that she had brought them along to show respect for the court but was not prepared to hand them over without word from the Supreme Court. She begged the court for more time, saying the SC was likely to release the documents anyway.
She said the subpoena from the Senate had already been included on the agenda of the Supreme Court, which meets en banc on Tuesdays, and would be tackled soon.
Although Senator Joker Arroyo said he was “disturbed” by how the trial was going, and warned that forcing Vidal to surrender the documents could lead to a clash with the Supreme Court, he did not enter a formal objection. With no objection on record, the matter was not put to a vote and Enrile’s order stayed.
Enrile later asked defense lawyer Serafin Cuevas to ask his client, the head of the Supreme Court, to “bear with us,” saying the Senate was only acting under its mandate to hear impeachment cases. He said the Senate was a “co-equal but coordinate” branch of government. He also asked Cuevas to convey to Corona that Vidal had no choice but to obey the impeachment court and should not be subject to sanctions.
At a press briefing while the impeachment court was in recess, defense lawyer Tranquil Salvador III said Corona had told the panel that it was “already okay” to release his SALNs to the Senate. He said the Chief Justice would not seek sanctions against Vidal, but could not speak for the rest of the Supreme Court. He added Corona is concerned that the Supreme Court’s procedure of having the court deliberate on requests for disclosure SALNs was not followed.
With his SALN released to the Senate, Corona will go down in history as the first magistrate to let anyone outside the judiciary see his net worth. Supreme Court spokesman Midas Marquez, in a hastily-called press conference, said Corona had already given his go signal for the release of the SALN, which covers the period 2002 to 2010.
“There’s really no big issue about it. Just for the assurance of the Clerk of Court, I was just summoned by the Chief Justice and was told to assure Vidal that she has nothing to worry about as far as the Chief Justice is concerned,” he said.
He said that Vidal is merely complying with the order of the impeachment court and the fact that she went there with the SALNs meant Corona had no intention to stop her. This did not keep the defense from trying to block the submission of the documents, however. Cuevas even said after Enrile’s ruling was implemented that if the SC penalizes Vidal, the Senate will have no power to compel the court to reinstate her.
“She just wanted to inform the court that there are existing policies of the SC,” Marquez said.
Article XI, Section 17 of the Constitution states that a “public officer of employee shall, upon assumption of office and as often thereafter as may be required by law, submit a declaration under oath of his office assets, liabilities, and net worth.”
The provision applies to the President, the Vice President, Cabinet members, the Congress, the Supreme Court, the Constitutional Commissions and other constitutional officers, and officers of the Armed Forces with general or flag rank.
The SC, however, in 1989 passed a resolution exempting the members of the judiciary from the rule since it might be used against them by the litigants with pending cases before the courts. (Sunnex)
