Corona did not ‘own’ Columns unit until 2009, his lawyers say

MANILA — Ownership of a unit at The Columns, a posh condominium in Makati City, was transferred to Chief Justice Renato Corona in 2009 “when he took actual possession,” his lawyers said Thursday in a legal memorandum it submitted to the Senate.
Citing the Civil Code, lawyers Serafin Cuevas, Jose Roy III, and Dennis Manalo, said “ownership does not pass by mere stipulation, but only by delivery.” They said that there are two types of delivery under the Civil Code. Actual delivery, “when the sold is placed in the control and possession of the vendee” and “symbolic delivery by the execution of a public instrument.”
“It should be noted, however, that Article 1498 does not say the execution of the deed provides a conclusive presumption of the delivery of possession,” the memorandum read.
It said the supposed transfer of ownership can still be disputed. “The presumptive delivery by execution of a public instrument can be negated by the failure of the vendee to take posssession of the land sold.”
The defense counsels said only registration and documentation “coupled with placing the buyer in actual, physical control of the property” can show that the unit was actually delivered.
Citing the Supreme Court in Santos v. Santos, the defense said that even with a deed of sale, “(if) the purchaser cannot have the enjoyment and material tenancy nor make use of it himself, or through another in his name, then delivery has not been affected.”
In her February 1 testimony at the impeachment court, Ayala Land Inc. assistant vice president Nerissa Josef said a deed of sale was executed with Cristina Corona, the chief justice’s wife, for a unit at the Columns in Makati City in 2004.
According to a hand-written letter from Mrs. Corona to Ayala-owned Community Innovations Inc., The unit was turned over to the Coronas after a final re-inspection in 2008. Josef said, however, that there was no official document to show when the unit was accepted, neither could she answer whether the keys to the unit were handed to the Coronas.
The delay was due to defects in the unit, the defense said.
“CJ Corona refused to accept delivery in order to preserve his right to pursue legal remedies against the developer for the repair of the defects and damage to the Columns unit,” the defense said. Because of this, Corona could not declare the unit in his SALN before 2010, it added.
The prosecution, who have been arguing that Corona did not truthfully disclose his net worth, said Corona should have declared the property since 2004, when the deed of sale was executed.
