Calorie Rules Make Diets A Federal Affair
(NewsCore) – WASHINGTON — Fans of convenience store hot dogs will get to read how many calories are in a dog. But beer drinkers won’t have to deal with the guilt after the Obama administration Friday issued proposed rules that vendors must follow to inform customers about calorie counts of a range of foods — from a Big Mac to a brownie.
Many food sellers are exempt, and for now the new regulations, which are designed to prod consumers to make healthier eating choices, exempt booze, The Wall Street Journal reported.
The rules, expected to take effect in 2012, provide details on how eateries with 20 outlets or more must comply with a new law to post the calorie counts of foods and drinks on menu boards. Vending-machine chains also have to post calorie counts.
The labeling provision was part of President Barack Obama’s 2010 health overhaul law. The new rules differ in certain areas from an earlier draft issued last year, in which the Food and Drug Administration (FDA) indicated that the calorie-posting requirement might extend beyond chain restaurants to encompass other businesses where food is sold.
At the time, movie-theater owners and supermarkets, among others, complained that the rule was burdensome. In its updated proposal unveiled late Friday, the agency left out movie theaters, along with airplanes, bowling alleys, amusement parks, hotels and other establishments where the sale of food is not a primary business.
The agency said it excluded them in part because they generally don’t present themselves to the public as restaurants. However, the regulation will apply to establishments where more than 50 percent of the total floor area is used for the sale of food.
Convenience stores still are required to post calorie counts, along with supermarket eateries, pastry and retail confectionery stores, coffee shops, snack bars and ice-cream parlors.
“As far as your waistline goes, it doesn’t matter whether you’re sitting at a restaurant,” said Margo Wootan, director of nutrition policy at the Center for Science in the Public Interest, which advocates for greater nutrition disclosure. “All those extra calories will make you fat — and, in fact, gigantic tubs of fatty popcorn will especially make you fat.”
FDA also said it “tentatively” concluded that bars and restaurants don’t have to post calorie labels on beer, wine and other alcoholic beverages. It cited the fact that alcoholic beverages are regulated by a different federal agency, the Alcohol and Tobacco Tax and Trade Bureau, and that it was not clear Congress intended the calorie-label provision to apply to such drinks, given the different agency jurisdictions.
At least 20 cities or states have passed local ordinances requiring calorie postings on menus, led by New York City in 2008. Whether those actually have curbed obesity is unclear.
A 2009 study published in the journal Health Affairs didn’t find evidence menu labeling influenced total calories purchased by New Yorkers. A Stanford University study of New York City Starbucks found average calories per transaction fell by six percent after calorie labeling started.
