Bill seeks to withhold funds for schools allowing corporal punishment

PUBLIC SCHOOLS that allow teachers to inflict corporal punishment on students stand to lose their funding if a bill filed by Senator Miriam Defensor-Santiago is passed into law.
Santiago’s bill bans the use of spanking, paddling, and other forms of physical punishment “however light, imposed upon a student.” The ban, which will only affect government-run schools and day-care centers, is meant to reinforce the Family Code, which already prohibits the use corporal punishment.
Santiago said that despite the prohibition, corporal punishment still persists in schools.
In August, a teacher in Argao town in Cebu was investigated for allegedly hitting a Grade 4 student with a meter stick. The meter stick reportedly broke from the repeated blows, which left the child with bruises on the shoulder and on his back.
Under the proposed Ending Corporal Punishment in Schools bill, “no funds shall be made available under any applicable government program to any school or institution that has a policy or practice which allows school personnel to inflict corporal punishment upon a student.”
The bill emphasizes the use of positive reinforcement and guidance instead of physical punishment. If passed into law, three-year grants will be made available to schools that request assistance in “improving school climate and culture by implementing school-wide positive behavior support approaches.” The money will be used to train school personnel in alternative forms of discipline that do not abuse students physically or emotionally, and to create a positive school environment.
The House of Representatives passed a bill against corporal punishment in schools in August. That bill, however, imposes penalties on people who inflict corporal punishment, not on schools. Teachers who inflict corporal punishment could get from one month to six months in prison. The bill also makes teachers liable under the Special Protection of Children Against Abuse, Exploitation and Discrimination Act. Violations of that act carry a penalty of 6 years in prison.
