Aquino gives up on Truth Commission

MANILA — President Benigno Aquino III said on Wednesday he will abide by the decision of the Supreme Court (SC), which junked with finality the Executive Order No. 1 that created the Philippine Truth Commission of 2010.
“We cannot do anything about it. The SC is the final arbiter of our laws and we are the implementor of the same, so we have to follow them,” Aquino said in an ambush interview during the opening ceremonies of the 2011 National Science Technology Week in SMX Convention Center.
The SC on Tuesday upheld its earlier ruling declaring the Truth Commission as unconstitutional since it violates the equal protection clause of the Constitution by zeroing in on the Arroyo administration.
The Truth Commission was initially tasked to investigate the anomalies hurled at the past administration of then President Gloria Macapagal-Arroyo.
Even without the Truth Commission, the Aquino vowed to serve justice in his administration by appointing a new Ombudsman: retired SC Associate Justice Conchita Carpio-Morales.
He noted the data, evidence, and testimonies gathered by the Truth Commission could still be utilized in building up cases against the past administration.
Justice Secretary Leila de Lima, meanwhile, said there is no more need to reiterate the creation of the Truth Commission to investigate the anomalies involving officials during the administration of Arroyo.
De Lima added that she has full trust and confidence in the capacity of the newly appointed ombudsman.
President Aquino on Wednesday administered the oath taking of Carpio-Morales in a private ceremony in Malacañang.
“The assumption of office of Justice Morales inaugurates a new era of integrity and independence in this crucial constitutional office,” said a statement read by presidential spokesperson Edwin Lacierda.
Aquino announced Carpio-Morales’s appointment as the new Ombudsman during his second State of the Nation Address (Sona) at the joint session of Congress last Monday.
Carpio-Morales succeeded other nominees for the anti-graft top post submitted by the Judicial and Bar Council (JBC) namely Justice Undersecretary Leah Armamento, former Justice Secretary Artemio Tuquero and Presidential Commission on Good Government Commissioner Gerard Mosquera.
Carpio-Morales replaced embattled former Ombudsman Merceditas Gutierrez who faced controversies and criticisms for allegedly sitting on the cases, involving former President Arroyo.
Arroyo asked the JBC to block the application of the retired Supreme Court justice citing tendency of being partial in treating her cases.
The former President noted that Morales “consistently” voted in favor of major cases, involving the Arroyo administration when she was still in the High Court.
While Aquino is confident that the cases against Arroyo would now prosper under Carpio-Morales, his allies in Congress meanwhile could not say for certain if the Pampanga representative and her allies will be charged and eventually convicted.
Aquino’s allies in the House of Representatives assured that the Supreme Court decision declaring the Truth Commission unconstitutional will not get in the way of the anti-corruption promise of the administration.
“Truth or no Truth Commission we can go on because marami namang mga ahensiya ng pamahalaan (there are other government agencies) that are already involved by the power provided for by the laws to do the investigation and file the necessary charges if needed,” House Majority Leader Neptali Gonzales II said in a text message.
Eastern Samar Representative Ben Evardone, chairman of the House committee on public information, added that apart from the Office of the Ombudsman, other government agencies such as the Department of Justice and the Sandiganbayan can still handle graft cases filed against Arroyo and her allies.
“The SC decision should not deter these agencies from pursuing the anti-corruption campaign of President Aquino,” Evardone said.
Minority Leader Edcel Lagman, chairman of former Arroyo’s political party Lakas-Kampi-CMD, meanwhile lauded the Supreme Court’s decision.
He said the High Court upheld the supremacy of the Constitution and the ascendancy of the rule of law in junking with finality the Truth Commission as a constitutional aberration.
Lagman said that the “final decision of the Supreme Court is a virtual sanction against the President who was found to have been motivated by partisan vengeance and selective retribution in solely targeting for prosecution his immediate predecessor.”
The Minority Leader challenged the constitutionality of the executive order as a patent violation of the equal protection clause for selectively investigating officials of the Arroyo administration and as an arrogation of the legislative power to create public office.
Arroyo is currently facing two plunder cases at the Office of the Ombudsman over alleged misuse of Philippine Charity Sweepstakes Office funds. Three other plunder cases have been filed at the Department of Justice. (Jill Beltran/Kathrina Alvarez/PNA/Sunnex)
