‘Win-win’ solution seen in land row

ANGELES CITY — Members of the Nepomuceno political clan, who owns a vast track of land in Barangay Cutcut here, are confident of a “win-win” solution over property dispute with a trader and golf course owner.
Councilor Brian Nepomuceno said an amicable settlement between the Neplum Inc. and Ruperto Cruz, owner of Royal Garden Gold and Country Club (RGGCC), is always possible.
“We are open to negotiations,” Nepomuceno, a lawyer by profession, said.
The operation of Royale Garden Golf Course and Country Club, located at the boundary of this city and nearby Porac town, was reportedly affected after the Neplum Inc. erected a concrete fence on a 1,000-square meter lot on January 16.
The fenced property, owned by the Nepomucenos, crosses the main road leading to Cruz’s golf course.
Nepomuceno said they will start talks with Cruz anytime this week. But he stressed that conditions of the agreement between the two parties are yet to be established.
“Depende yun sa kakayahan [ni Cruz] na [siyang] humihigi ng right of way,” Nepomuceno said.
He also clarified that their negotiations with Cruz is not all about money.
“The price of the lot is not the issue here,” Nepomuceno said, referring to the fenced 1,000 square meter lot they own.
Nepomuceno also belied reports saying there were 104 Koreans trapped inside the golf course when they erected the fence in their property, saying the hostage-taking report was exaggerated.
Neplum earlier claimed that most of the real property, which constitutes RGGCC is situated in Barangay Santa Cruz, Porac and the golf course is accessible through a public road in said villages.
Neplum Inc. is in the process of developing the property into a residential and commercial subdivision.
On January 14, 2011, Neplum said it sent a written notice to the management of RGGCC informing the latter of its plan and advice to cease and desist from trespassing through the property.
Cruz on January 18 was able to secure a temporary restraining order (TRO) valid for 72 hours from the court, which ordered for the demolition of the fence erected by Neplum.
The fence was demolished on the night of January 18 and the operation of the RGGCC was restored.
However, the Nepomucenos again erected recently a wooden fence after the court denied Cruz’s application for a writ of preliminary mandatory injunction.
Guests going to the golf course are now using an alternate road in Porac town. (Reynaldo G. Navales)
