Source: Congress entitled to only one vote in JBC

MANILA (Updated) — Justices of the Supreme Court who did not apply for the position of Chief Justice have resolved that Congress is entitled to only vote in the Judicial and Bar Council (JBC), a source familiar with the matter said Tuesday.
Seven of the nine justices present during the deliberation sided with the arguments presented by former Solicitor General Francisco Chavez, who earlier asked the Court that Iloilo Representative Niel Tupas Jr. and Senator Francis Escudero should not sit together in the JBC for being unconstitutional.
Acting Supreme Court spokesperson Gleoresty Guerra declined to confirm the information as she asked the media to just wait for the formal announcement on Thursday.
“You know, there may be a change of vote prior to the promulgation of the decision, so I’ll just let you know when the decision is promulgated,” she told reporters, adding Thursday’s announcement will also contain the dissenting opinion of two magistrates.
Chavez also withheld comment, saying he will have to “wait for the Supreme Court’s official release of the decision.”
In his petition, Chavez said the composition of the JBC, the body tasked to screen applicants and nominees for judicial posts and the post of Ombudsman and Deputy Ombudsmen, should only be seven under Section 8, Article VIII of the Constitution.
In reality, however, the legislative branch sends two representatives since 1994, thus giving it two votes in the multi-sectoral council.
Associate Justice Jose Mendoza was tasked to pen the decision that transpired following the session presided over by Associate Justice Diosdado Peralta.
The justices who took no part are aspirants to the position vacated by Renato Corona last May 29.
They are Senior Associate Justice Antonio Carpio and Justices Presbitero Velasco Jr., Teresita Leonardo-de Castro, Arturo Brion, and Maria Lourdes Sereno.
Corona was ousted by the Senate impeachment court for betrayal of public trust and culpable violation of the Constitution for concealing some P180-million worth of cash deposits in the asset statement.
