Sereno envisions fair, effective judiciary
MANILA (3rd Update, 6:00 p.m.) — Chief Justice Maria Lourdes Sereno said Wednesday that only through cooperation and understanding of other members of the judiciary and the Filipino people can the country achieve fair and impartial justice. Outlining her plans for the next 18 years, Sereno said there is a need for the judiciary to redefine itself by being responsive to today’s challenges of climate change and transparency.
This means the courts should implement paperless transactions and at the same time be the agents of openness. She also asked the public to give the Supreme Court a time to reflect.
“I believe that judicial reform must not revolve around solely on the personality of the Chief Justice rather it must be the product of a collective vision one that is forged under the leadership of the Chief Justice. I think inevitably this dialogue among members of the judiciary will lead to significant changes in governance practices within the judiciary,” Sereno said.
While she stood by her decision not to give media interviews after her speech at the 23rd Conference of the Presidents of Law Associations of Asia (POLA), Sereno confirmed to reporters that she will fully disclose her statement of assets, liabilities and net worth (SALN).
“As earlier conveyed to you, a statement will be issued soon that will indicate what has taken place in the en banc session yesterday (Tuesday) and that will include the full disclosure of SALN of the Chief Justice. Please be patient as I take very good care in ensuring that I am exact, deliberate and careful all the time,” she said at the Marriott Hotel in Pasay City.
Roan Libarios, president of the Integrated Bar of the Philippines (IBP), supported Sereno’s move as he asked other justices to follow suit.
Sereno, in the summary of her 2010 SALN, reported assets of P17,904,510.14 and liabilities amounting to P142,342.88, for a net worth of P17,762,167.26.
In June, the Court released guidelines on how the public can access the SALNs, which was a result of consultations with the justices of Sandiganbayan, Court of Appeals, Court of Tax Appeals and judges of lower courts.
Senators: Disenchantment with Sereno just temporary
Her ascension to the highest post in the judiciary was met with cheers by different groups and reportedly jeers by her senior colleagues in the bench.
Court sources said some justices even skipped the regular lunch after Tuesday’s en banc session, signaling discomfort with the appointment of Sereno, the third most junior justice after Bienvenido Reyes and Estela Perlas- Bernabe.
That disenchantment is natural but only temporary, Senator Franklin Drilon said, as Sereno should prove that she can build reforms in the judiciary.
“For the first time in the political history of our country the CJ will stay for 18 years. This is important because the reforms in the judiciary will take time. It takes time, you cannot do it overnight.
The judicial ship must be turned around slowly, because an abrupt change may cause the judicial ship to capsize,” he told reporters.
Among the problems cited by Drilon are clogged dockets, vacancies in judges and court personnel and holes in the Rules of Court and Procedures which can be availed of or abused by the litigants to delay the resolution of cases.
Senator Edgardo Angara said Sereno’s success will depend on winning the trust of her colleagues. Like Drilon, Angara said the disenchantment may just be a “temporary glitch” for a “talented” woman.
“[Y]ou must present to your colleagues a program of reform that is bigger than any one of them and therefore they will believe in your ability, in your capacity for vision as well as for execution,” he said.
Sereno took the time to visit the different offices in the Supreme Court before the start of the full-court session although she was not able to catch the magistrates in their respective chambers.
Her gesture was a departure from the practice of past chief justices, who received courtesy calls from fellow magistrates and various units in the SC.
Palace welcomes Sereno decision to disclose assets
Malacanang welcomed the decision of Sereno to fully disclose her SALN.
“It was good that Chief Justice Sereno decided to open up her SALN to the public,” Presidential spokesperson Edwin Lacierda.
Sereno’s predecessor Renato Corona was impeached and convicted for failure to fully disclose his assets in his SALN.
Following Sereno’s move, there have been calls for her to institutionalize the release of the SALN of all the sitting justices.
Malacanang, however, refused to comment on the clamor leaving the matter to the wisdom of the judiciary.
“Well, I think that’s an en banc decision or a decision to be decided by the Supreme Court justices,” said Lacierda.
He noted that as far as the Executive branch is concerned, disclosure of assets has been a practice for a long time.
Malacanang likewise welcomed the decision of its allies in Congress to strip the judiciary of its prerogative not to disclose budget when hiring people.
“Certainly anything that opens up when you’re referring to hiring, it promotes transparency and that is certainly welcome by the people,” said Lacierda.
“I think we have always advocated transparency in governance and if it’s something that will help the cause of promoting transparency insofar as the judicial branch of government and certainly it would be nice to see transparency also,” he added. (Virgil Lopez/Jill Beltran/Sunnex)
