Lawmaker sees graft, coercion in Corona impeach plaint

LEADERS of the House of Representatives may have violated the Anti-Graft and Corrupt Practices Act by pressuring members of the House majority to sign the impeachment complaint against Chief Justice Renato Corona.
Submitting to questions from Senator Miriam Defensor-Santiago, Navotas City Representative Tobias Tiangco recounted how he felt threatened into signing the complaint, which he eventually refused to do.
In his testimony on Monday, Tiangco said House Speaker Feliciano Belmonte Jr. had told the majority that Corona’s impeachment was “non-debatable”.
“He was trying to convince us that there was a probable cause, but to be convinced, I needed to see documents,” he told the impeachment court Monday.
He added that aside from those asked by Muntinlupa City Representative Rodolfo Biazon and Cagayan De Oro City Representative Rufus Rodriguez, no questions were entertained during the December 12, 2011 caucus.
Santiago then read from Section 3(a) of the Anti-Graft and Corrupt Practices Act, which prohibits “persuading, inducing or influencing another public officer to perform an act constituting a violation of rules and regulations duly promulgated by competent authority or an offense in connection with the official duties of the latter, or allowing himself to be persuaded, induced, or influenced to commit such violation or offense.”
Santiago asked Tiangco if he felt that this applied to his colleagues at the House.
“So, you’re alleging your colleagues are guilty of violating the Anti-Graft and Corrupt Practices Act?” Santiago said.
Tiangco replied in the affirmative but made clear that he only meant “those who spoke at the majority caucus.”
Santiago then read from Article 286 of the Revised Penal Code, which imposes a penalty “upon any person who, without any authority of law, shall, by means of violence, threats or intimidation, prevent another from doing something not prohibited by law, or compel him to do something against his will, whether it be right or wrong.”
Tiangco said this applies to House Majority Leader Neptali Gonzales II, whom he said threatened him with expulsion if he testifies as a witness for the defense.
Before Tiangco testified, Gonzales said the decision to volunteer as a witness was up to the Navotas lawmaker but warned “if he dishonors the House members, it may constitute disorderly behavior and warrant disciplinary action such as expulsion.”
News reports on Tuesday quoted Gonzales as saying many House members were offended at the perceived slight on the integrity of the House of Representatives. On December 12, 2011, 188 members of the House endorsed the impeachment complaint against Corona. Gonzales has been quoted as saying Tiangco should prepare for expulsion proceedings.
Santiago, who has been critical of the House prosecution panel in the past, told Tiangco that depending on how things develop because of his testimony, “you will either end up a national hero to the public or a traitor to your colleagues.” (Jonathan de Santos/Sunnex)
