House approves Lemon Law

MANILA — The House of Representatives approved on third and final reading Tuesday the “Lemon Law of 2011” that will protect buyers of brand new vehicles later discovered to be of substandard quality.
House Bill 4841, or “An Act Strengthening Consumer Protection in the Purchase of Brand New Motor Vehicles” or the Lemon Law of 2011, was authored by Representatives Bernadette Herrera-Dy (Bagong Henerasyon), Ma. Carmen Zamora- Apsay (Compostela Valley), Mark Villar (Las Pinas), Susan Yap (Tarlac) and Ma. Amelita Villarosa (Mindoro Occidental).
Herrera-Dy said the measure gives a buyer of a brand new vehicle the right to demand replacement “with similar or comparable motor vehicle” if the vehicle is later discovered to be suffering from factory defects or is of substandard quality.
The enactment of a Lemon law originated in the United States. Automobiles that are found to be defective before they are sold were labeled as “lemons”.
The buyer may also opt to return the defective vehicle and demand a refund of the purchase price and additional collateral charges such as vehicle registration fee.
“The passage of an anti-lemon law is long overdue, it is necessary for us to guarantee that our consumers will get their hard-earned money’s worth…Riding in a vehicle with factory defects also jeopardizes the lives of both the driver and passengers,” Herrera-Dy said.
The bill provides a 12-month period or the first 20,000 kilometers of the vehicle as the coverage of the Lemon Law Rights Period.
Within this period, a vehicle owner can report defects or conditions that substantially impair the use, value, or safety of a brand new vehicle and demand repairs.
Buyers may invoke lemon law rights if, after four separate repair attempts, they are dissatisfied with the outcome of the remedial measures.
Herrera-Dy said returned vehicles may be placed for resale provided that the distributor or manufacturer will disclose in writing the vehicle’s condition.
Those found violating the Lemon Law face a penalty of a minimum P100,000 in damages to be paid to the aggrieved party, without prejudice to the filing of criminal and civil complaints. (Sunnex)
