High Court told: Don’t summon doctors anymore
FORMER President Gloria Macapagal-Arroyo has asked the Supreme Court (SC) to refrain from compelling her doctors to reveal her medical condition on this week’s oral arguments on a travel restraint circular.
In a six-page petition, Arroyo’s lead counsel Estelito Mendoza said Arroyo’s argument of upholding her constitutional right to travel does not rest on her medical condition.
On December 1, the Court is expected to wrap up the oral arguments on the constitutionality of the Department of Justice Circular 41, which became the basis of Justice Secretary Leila de Lima in issuing a watchlist that prevented Arroyo from seeking medical help abroad.
“Thus the subpoena to bring the ‘latest medical abstract of the medical condition of petitioner GMA (Arroyo) subsequent to those appended to the petition’ is irrelevant to nor will it aid this Honorable Court in determining whether petitioner GMA’s constitutional right to travel has been violated,” the petition read.
The former President’s camp said the SC is not a trier of facts and that the medical abstracts they have issued are already part of the records of the case.
Mendoza said the doctors should focus on treating Arroyo, barring any distraction and “additional stress of media attention, court proceedings, ethical dilemmas, and all the while facing threats of administrative sanctions.”
The Office of Solicitor General earlier asked the justices to require the attendance of doctors Mario Ver, Juliet Gopez-Cervantes and Roberto Mirasol in the oral arguments and to bring Arroyo’s medical abstracts with them.
However, the same doctors told the Pasay City Regional Trial Court (RTC) branch 112 last week that Arroyo’s health condition is already improving.
The former President is currently under police custody at the St. Luke’s Medical Center in Taguig City after she as charged of electoral sabotage in connection with the 2007 senatorial elections.
Meanwhile, Arroyo’s possible detention facility at the Southern Police District (SPD) is “ready for occupancy,” SPD spokesperson and Chief Inspector Jenny Tecson said.
She made these remarks after the police station received Judge Jesus Mupas, presiding judge of the Pasay City Regional Trial Court (RTC) Branch 112, before noon on Monday.
Accompanied by clerk of court, lawyer Joel Pelicano and court sheriff Rodelio Buenviaje, Mupas inspected the lounge that has been converted into a makeshift detention area that was prepared for Arroyo.
Mupas is set to decide on a request from the Arroyo camp to place her under house arrest.
The airconditioned facility features a kitchen sink with running water from a faucet and a comfort room, aside from a bed and pillow.
Authorities have also installed a wooden divider to give any occupant privacy as well as to separate the sleeping and receiving area.
Tecson also said the SPD is prepared to secure the former commander-in-chief should the court orders her detention at their facility. The station can beef up security if needed to ensure her safety, she added.
For his part, SPD Officer-In-Charge Senior Superintendent James Bucayu said a security fence can be built and additional policemen can be deployed at the entry and exit points to further boost the facility’s security.
“I won’t pre-empt. Bahala na ang korte kung saan nila gusto ilagay si former president Arroyo but kami ready naman kapag sinabi ng korte,” Bucayu said.
Pelicano said the court will consider three factors as to Arroyo’s detention facility namely security, comfort, and proximity to a hospital.
Mupas, Pelicano, and Buenviaje also visited the Veterans Memorial Medical Center where former president, Joseph Estrada was previously detained for plunder charges during the Arroyo administration and the Armed Forces Medical Center, also called V. Luna General Hospital.
The three also inspected the Philippine Orthopedic Center also in Quezon City.
Pelicano also said the court may render a decision regarding Arroyo’s detention arrangements before Christmas.(Virgil Lopez/AH/Sunnex)
