Filipino doctor nabbed for defrauding US government

GOVERNMENT operatives arrested over the weekend a United States-based Filipino doctor who was accused of defrauding the US government’s health care program of $3 million (P129 million).
Suspect Dr. Eric Chan, alias Eric Uy Garchitorena, with last known address at No. 684 Mapua St., Manila, was arrested Saturday by National Bureau of Investigation (NBI) agents inside Camp Aguinaldo on the basis of a warrant issued by the Manila regional trial court branch 1.
NBI Foreign Liaison Division chief Claro de Castro Jr. said that since Chan’s return to the country, he became a medical corps reservist at the Armed Forces of the Philippines (AFP) under the name Lieutenant Colonel Eric Garchitorena.
The suspect fled to the country to evade arrest and prosecution after he was charged with a string of cases ranging from felony and conspiracy to commit crime, to grand theft before the Superior Court of the State of California, County for Los Angeles.
Being a subject of an extradition case, the Philippines’ Department of Justice, representing the US government, filed a case before the Manila court.
“Records showed that Chan was found criminally liable for health care fraud or presenting false medical claims by collecting and receiving payments from the California State Medical Program of over $3 million. It was reported to us that the subject fled to the Philippines to evade arrest and prosecution,” De Castro said.
An investigation report prepared by de Castro showed that Chan, who co-owns and operates Green Cross Medical Clinic in Carsons, California, and his co-conspirators Diadema Digma and Chan Annilie Arcangel Ferrer, were allegedly engaged in a scheme to defraud the State of California’s Medical program by receiving payment for false and fraudulent claims.
It was alleged that Chan and the other accused first hired licensed physician Dr. Hyun Hong Kim and used the doctor’s provider number in order for them to claim some $516,656 from Medi-cal for the non-existent services.
“After Dr. Kim discovered the unauthorized billing in her name, she left the medical clinic and notified authorities to have her provider number deactivated,” De Castro said.
The same scheme, according to De Castro, was made by Chan and the two other accused in the case of Dr. Saifuddin Saifee, whom they hired for their newly named Evergreene Medical Clinic so that they could allegedly use his provider number. The NBI-FLD chief said payments totaling to $1,695,252.10 were paid to Saifee’s provider number without doctor’s knowledge.
In April 1998, a search warrant was executed at Evergreene Medical Clinic and at Chan’s residence. De Castro said Chan and his co-conspirators were arrested but posted bail afterwards.
After being released, the fugitive reportedly opened a new clinic called West Coast Intermed Management and hired a new licensed physician named Herman De Bardlabon so he can again acquire a new provider number to continue his scheme.
Dr. Bardlabon was paid $6,000 and 10 percent of the clinic’s income.
Chan allegedly persuaded Dr. De Bardlabon to order unnecessary medical diagnostic tests on patient who had been brought to the clinic to submit to medical testing and to sign off on fabricated patient charts and the copied test results to make it appear he ordered the test and analyzed the result.
Ferrer, on the other hand, hired several medical assistants and directed them to fabricate patient charts for medical beneficiaries who had never been treated, according to De Castro.
In this transaction, Medi-cal paid Dr. Bardlabon worth $1 million through his provider number. The NBI official said the doctor retained 10 percent of the said funds as his fee while he gave the rest to Chan and Ferrer.
