De Lima replacement in JBC need not come from DOJ

PRESIDENT Benigno Aquino III still has the final say in choosing for the replacement of Justice Secretary Leila de Lima in the Judicial and Bar Council (JBC), Malacañang said Thursday.
Jose Mejia, a member of the JBC representing the academe, said the replacement of de Lima as representative of the Executive department in the body that will screen nominees for the next Chief Justice of the Supreme Court should come from the Department of Justice (DOJ).
De Lima inhibited from the proceedings since last month when her name was floated as one of the possible successors to ousted Chief Justice Renato Corona, but Malacañang on Monday got a go-signal from the JBC to name a temporary representative soon.
Presidential spokesperson Edwin Lacierda believed Aquino could appoint someone as de Lima’s replacement outside of the DOJ.
“Based on the records of the constitutional commission when the Secretary of Justice sits in the JBC, he does not sit there as SOJ, he sits there primarily as the alter ego of the President,” he said.
“The JBC stated their preference but the choice of who will be the replacement of Secretary Leila de Lima is with the Office of the President,” he added.
He said it could be an undersecretary or a member of the Cabinet since they are alter egos of the President.
But Lacierda said the President has yet to decide on who will be Malacañang’s representative to the JBC.
Lacierda said they have no information on whether Justice Undersecretary Francisco Baraan is being considered to represent the Palace in the screening body.
Baraan also neither confirmed nor denied to Sun.Star if he will be named for the position, saying he has “no idea.”
The JBC is expected to submit a shortlist of nominees for the replacement of Corona to the Chief Executive on or before July 30.
The JBC is a constitutional body tasked to screen and submit a shortlist of nominees from which the President will make appointments to vacant judicial posts.
De Lima inhibited from the selection process since she was nominated for the Chief Justice post along with Acting Supreme Court Justice Antonio Carpio.
Both officials, however, could still screen nominees for other vacant judicial posts.
At the Supreme Court, preparations for the public interviews of the 22 candidates for the position are in full swing.
The interviews, which will be opened for live coverage, are set at the Division Hearing Room located at the left side of the High Court lobby. At least 56 people can be accommodated inside since there are eight rows with a seating capacity of seven individuals.
The last row of seats inside the Division Hearing Room shall be reserved to media on a “first-come, first-served” basis, but only one reporter per media entity can enter.
However, a projector showing live feed shall be placed outside the Division Hearing Room for the rest of the public and the media who may not be accommodated inside.
JBC presiding officer and Associate Justice Diosdado Peralta said the Dignitaries Lounge, which is just a few meters away from the Division Hearing Room, will be used as holding area for the candidates.
“It will be an ordinary proceeding. We expect everybody to be relaxed and possibly, we’ll not let them feel nervous,” Peralta told reporters.
Six nominees led by de Lima will be grilled at the start of the four-day activity on July 24.
