Court asked to reconsider recall order vs flight attendants

A GROUP of Philippine Airlines’ (PAL) flight attendants has asked the Supreme Court (SC) to reconsider an order that recalled an earlier final decision that said their retrenchment was illegal.
The High Court’s order dated October 4 has no constitutional basis and was only issued after PAL counsel and former Marcos justice minister Estelito Mendoza wrote a letter to the chamber, the Flight Attendants and Stewards Association of the Philippines (Fasap) said on Monday.
Nothing in the Constitution or in any law allows the High Court to recall a final and executory judgment including its September 7 decision that said 1,400 PAL flight attendants’ retrenchment as illegal, Fasap’s counsel Santiago Kapunan said.
The Fasap’s 10-page appeal further cited Article VIII, Section 14 of the Constitution, which provides that “(n)o decision shall be rendered by any court without expressing therein clearly and distinctly the facts and the law on which it is based.”
“The resolution of the Second Division in GR no. 178083 is a valid final and executory judgment. It is therefore legally immutable and should not have been recalled,” the group said.
Earlier, Mendoza wrote the Court, citing technicalities of the September 7 decision. This resulted in the recall of the September 7 resolution on October 4 and the transfer of the case to the en banc for final resolution and “to avoid further confusion.”
“The Supreme Court’s credibility is at stake here. Sadly, because of their questionable recall, 1,400 lives are affected. We can never fathom the suffering and profound pain of the illegally retrenched PAL
flight attendants,” Fasap president Roberto Anduiza said.
On July 22, 2008, the SC ruled in favor of Fasap declaring as illegal the dismissal of 1,400 flight attendants in 1998.
A month later on August 20, PAL filed a motion for reconsideration but this was junked with finality in October 2, 2009.
However, on January 2, 2011, PAL filed a second motion for reconsideration, which the SC denied last September 7 saying “no further pleadings shall be entertained.”
For its part, PAL has withheld comment regarding the matter.
“We won’t comment on the motion for reconsideration filed by Fasap. We haven’t seen a copy yet,” PAL vice president for corporate communications Joey de Guzman told Sun.Star.
Lawmakers and Malacañang have since criticized the High Court for alleged flip-flopping on the case but Chief Justice Renato Corona hit back last week, saying those who were unfavorable to the decision should study the matter first. (JGV/Virgil Lopez/Sunnex)
