DOJ: No case yet against Gatdula

STATE prosecutors are not authorized to initiate a criminal complaint against former National Bureau of Investigation (NBI) director Magtanggol Gatdula for his alleged involvement in the kidnapping of an undocumented Japanese woman.
The complaint should come from Noriyo Ohara, the suspected kidnap and extortion victim, or from her foster family in Pangasinan, Justice Undersecretary Francisco Baraan III said on Thursday.
His response came after a Manila court issued a temporary order stopping the Department of Justice (DOJ) from launching a preliminary investigation that will determine Gatdula’s criminal liability. The temporary restraining order is good for 20 days.

“We cannot start a preliminary investigation because there is no complaint against him (Gatdula). If a criminal complaint will be filed, it will be filed by the complainant — either by Ohara or the Marzans. There is no case without a complaint,” Baraan told reporters.
Justice Secretary Leila De Lima earlier ordered a further review and reassessment of fact-finding panel’s recommendations as far as the criminal culpabilities of the former NBI chief are concerned.
The other respondents, however, were to be subjected immediately to a preliminary investigation.
Gatdula had blamed politics as behind the decision of the fact-finding panel to recommend him to be subjected for a preliminary investigation for kidnapping and serious illegal detention of Ohara, who has been in the country since 2009.
As a result, Gatdula filed an urgent petition for certiorari and prohibition with the court after he was sacked by President Benigno Aquino III last January 19.
Taking the witness stand last Monday, Gatdula said that his civil rights were violated when the Baraan-led panel issued its supposed “railroaded” recommendation report on the kidnapping case of Ohara.
He claimed he was not given due process, that his right against self-incrimination, the right to remain silent and the right for a counsel during an investigation were all violated with the release of the panel report. (Virgil Lopez/Sunnex)
