Bill filed to encourage govt-private sector partnerships

SENATOR Edgardo Angara has filed a bill that will repeal the Build-Operate-Transfer (BOT) Law and opens up more options and incentives to promote joint ventures with the government.
“The Aquino administration has among its priorities the strengthening of public-private partnerships (PPPs) in the country, and rightly so.
However, difficulties and shortcomings in policy and fiscal conditions have considerably dampened the interest in such ventures,” Angara, vice chairman of the Senate finance committee said.
The bill lists nine types of PPPs that government agencies and private firms can enter into. Aside from BOT, where a joint venture builds infrastructure and charges fees for its use for a set period before ceding it to the government, the bill also includes Build-Transfer, where the infrastructure is turned over after completion. The government then pays the private firm according to a set schedule.
The bill also allows Build-Lease-Transfer and Build-Transfer-Operate deals, which will let the government earn from franchises granted to private firms. Joint ventures may also be Contract-Add-Operate deals, where an existing government structure is improved and then rented by a private firm, or a Development-Operate-Transfer type, where private investors are given the right to develop adjoining property.
Under the DOT venture, firms “enjoy some of the benefits the investment creates such as higher property or rent values.”
Rehabilitate-Operate-Transfer contracts give private investors authority to fix up, run, and collect fees for a set period while Rehabilitate-Own-Operate deals grant a franchise indefinitely.
“As long as the operator is not in violation of its franchise, it can operate the facility in perpetuity,” Angara’s bill reads.
Angara’s proposal opens up infrastructure projects and the delivery of public services in energy, transport, water, communications, information technology, education, health, tourism, culture, sports, and “any other area as may be prescribed.”
“There is a need to revive private sector participation in the financing of various large-scale projects, infrastructure and services, so that the burden of national growth and development can be shared by government and private companies alike,” the senator said.
The bill also guarantees compensation in case the contract is “revoked, cancelled, or terminated” as long as it was not done so through the fault of the private investor. Investors can also terminate contracts in case the government defaults on its obligations if that “cannot be remedied, or if it can be remedied, shall remain unremedied for an unreasonable length of time.”
Although PPP projects will be subject to the approval of the National
Economic and Development Authority, the bill, if passed, will create a Public Partnership Center under the Department of Trade and Industry as a go-between with investors. Among its functions will be promoting and marketing PPPs, business development, and acting as an information center for investors and government agencies. (Jonathan de Santos/Sunnex)
