Arroyo, 35 others face electoral sabotage probe

MANILA (Updated 6:15 p.m.) — A special joint panel looking into fraud during the 2007 elections in Mindanao has recommended a preliminary investigation for former President Gloria Macapagal-Arroyo’s involvement in supposed electoral sabotage.
A joint Department of Justice (DOJ) and Commission on Elections (Comelec) panel named Arroyo, now a Pampanga representative, and 35 others in connection with alleged cheating in the 2007 midterm elections.
Other personalities recommended for preliminary investigation for electoral sabotage include former Comelec chair Benjamin Abalos Jr., former Comelec commissioner Nicodemo Ferrer, former Justice Secretary and former Team Unity lawyer Alberto Agra, and detained former Maguindanao governor Andal Ampatuan Sr., among others.
The fact-finding team led by Assistant Secretary Zabedin Azis gathered and collated reports and documentary evidence, intelligence information, and investigative leads, and conduct interview and take testimonies of resource persons during the 2004 and 2007 elections.
For its part, the preliminary investigation committee, chaired by Prosecutor General Claro Arellano, will determine probable cause among those recommended for investigation by the fact-finding team.
Justice Secretary Leila de Lima earlier said that the preliminary investigation panel will conclude its probe by November or at the latest, before Christmas.
As a result, de Lima said she may extend until November 5 Arroyo’s inclusion in the Bureau of Immigration’s watch-list, forcing her to seek permission from the Justice secretary whenever she needs to leave the country.
Arroyo was discovered to have conspired in tampering with election materials in Maguindanao by preparing manufactured election returns, which became the basis of canvass and resulted in the increase of her votes in favor of some candidates, the fact-finding team said in its 79-page report.
“GMA, former president, (is recommended for preliminary investigation) for giving direct instruction to manipulate the results of the senatorial elections in Maguindanao by ordering Ampatuan Sr. to implement a ’12-0′ result in the province of Maguindanao in favor of Team Unity senatorial candidates, and to alter or change the results if necessary,” the panel said.
Abalos implemented Arroyo’s orders by reminding poll supervisors in the Maguindanao, as well as in North and South Cotabato to fix the elections.
Ferrer, then chairman of Task Force Maguindanao, was likewise charged for authenticating the manufactured election documents submitted by election officers in General Santos City despite vigorous objections from counsels of candidates.
Agra was charged for covering up the manipulation of poll results in North and South Cotabato. The report said he advised provincial election supervisors to skip attending the continuation of the canvassing before the National Board of Canvassers until securing clearance from Malacañang.
Furthermore, he engaged in partisan political activity, being then the incumbent Government Corporate Counsel, having been appointed on February 28, 2007.
The fact-finding panel also recommended further investigation on the involvement of former First Gentleman Jose Miguel “Mike” Arroyo for insufficiency of evidence despite that their names have cropped up for having taken part, directly or indirectly, in the rigging of the elections.
The fact-finding team also referred to the joint panel the complaint filed by Senator Aquilino “Koko” Pimentel III, which also cited the affidavits of the same witnesses interviewed by the panel.
It further cited the findings of the Senate Electoral Tribunal (SET) to the effect that most of the ballots used in the elections and the election returns in Maguindanao are fake and spurious, thereby confirming the electoral fraud and manipulation of results in the province of Maguindanao during the 2007 polls.
Others charged for conniving in the North and South Cotabato election fraud were lawyer Michael Abas, former acting regional election director for Soccsksargen; Colonel Reuben Basiao, former ISAFP Director for Soccsksargen; ISAFP Major Joey Leaban; lawyer Jaime Paz, chief of staff of Abalos; Romy Dayday and Jeremy Javier of PSG and ISAFP, respectively.
In Maguindanao, other personalities charged were a certain “Butch,” a personnel of Unas who prepared the filled up ERs; and election officers and assistants, namely: Estelita Orbase, Elisa Gasmin, Elsa Atinen, Saliao Amba, Magsaysay Mohamad, Salonga Edzela, Ragah Ayunan, Susan Cabanban, Russam Mabang, Asuncion Reniedo, Nena Alid, Ma. Susan Albano, Rohaida Khalid, Araw Cao, Jeehan Nur, Alice Lim, Norijean Hangkal, Christina Dalope and Maceda Abo. (JCV/Sunnex)
