Justice department to lead in joint election fraud probe

THE Department of Justice (DOJ) will be the lead body in a special joint panel that will probe allegations of election fraud that took place in 2004 and 2007.
This was announced by the DOJ and the Commission on Elections (Comelec) in a joint press briefing on Tuesday.
A five-person panel will be formed by the two bodies, three from the DOJ and two from the Comelec, Justice Secretary Leila de Lima and Commission on Elections (Comelec) Chairman Sixto Brillantes said in the briefing.
Panel members will be identified on Wednesday along with the designation of a joint secretariat and legal support teams, the officials said.
The panel’s first assignment will be to formulate ground rules, including mechanics, proceedings, venue, and the schedule of the investigation, which will be subject to the approval of both agencies.
Formulation of rules may take up to seven days, Brillantes said.
The probe will be open to the public “unless there are reasons to make them executive sessions,” de Lima said.
The venue, she added, could be held alternately at the DOJ and Comelec head offices, which are both in Manila.

Among those to be summoned by the joint panel include “former election officials, incumbent poll officials, former government officials, military, police,” de Lima said.
The probe will not overlap with the one being called by the Senate since the joint probe has a different purpose and it is not in aid of legislation.
The 2004 elections was marred by the “Hello Garci” scandal, which erupted after digital audio files of a wiretapped conversation was uncovered in 2005, involving a man and a woman, allegedly former Comelec commissioner Virgilo Garcillano and former president Gloria Arroyo who were talking about rigging the presidential elections results.
In the 2007 polls, claims of massive irregularities were publicly brought up after the administration’s Team Unity “improbably” swept the Genuine Opposition senatorial ticket as reflected in the results of the Maguindanao polls.
Calls seeking a new investigation on the alleged 2004 and 2007 poll frauds snowballed after suspended Autonomous Region in Muslim Mindanao governor Zaldy Ampatuan, dismissed provincial election supervisor Lintang Bedol, three other witnesses from Maguindanao, and a team of police officials disclosed their corroborating allegations regarding the widespread cheating.
