22 individuals to undergo public interviews for CJ

MANILA (2nd Update, 6:49 p.m.) — Twenty-two people composed of sitting Supreme Court justices, private practitioners and law professors will face the members of the Judicial and Bar Council (JBC) on July 24 in a public interview seeking to determine their fitness to lead the judiciary. In a meeting on Friday, the JBC decided to reduce the number of nominees for the position of Chief Justice from 26 to 22 after screening them based on the minimum requirements set by the Constitution.
Those who failed to make the cut are Jocelyn Esquivel, former Malabon Trial Court Judge Florentino Floro, Manila Regional Trial Court Judge Amelia Tria-Infante and lawyer Ferdinand Jose Pijao.
Lawyer Jose Mejia, who represents the academe in the JBC, told Sun.Star that Esquivel is a registered nurse while Floro was removed from the judiciary in 2006 due to mental illness.
Floro was also sued by the Office of the Court Administrator which investigated about 13 administrative cases lodged against him by his own judicial staff. The Supreme Court found him guilty of seven out of 13 administrative charges and ordered him to pay the amount of P40,000 as penalty.
Pijao, who was born in 1937, is beyond the retirement age of 70 for members of the bench while Infante was fined P11,000 in September 2010 by the High Court for the turtle pace hearing and adjudication of cases at the Manila RTC branch 9.
Under the Constitution, a member of the Supreme Court must be a natural-born citizen of the Philippines, at least 40 years of age, must have been for 15 years or more, a judge of a lower court or engaged in the practice of law in the country, and must be of proven competence, integrity, probity and independence.
With this development, the following names will comprise the long list of applicants which will be published in newspapers on Monday.

They will battle for the position left by Renato Corona, who was ousted by the Senate impeachment court last May 29 for betrayal of public trust and culpable violation of the Constitution.
Of the nominees, six are incumbent members of the High Court: Carpio, Velasco, de Castro, Brion, Abad and Sereno, who was named as magistrate by President Benigno Aquino III in August 2010.
Government officials include de Lima (Justice Secretary), Bautista (Presidential Commission on Good Government chairman), Jardeleza (Solicitor General), Sarmiento (Elections Commissioner), Rodriguez (Cagayan de Oro City Representative) and Herbosa (Securities and Exchange Commission chairperson).
The rest are private lawyers and former heads of the country’s top performing law schools: Legarda (women’s rights advocate), Villanueva (former Ateneo de Manila law dean), Diokno (De La Salle University law school dean), Valdez (University of the East law dean), Pangalanan (former University of the Philippines law dean) Zamora (former San Juan City Representative), Morales (University of the Philippines professor), Siayngco (retired RTC judge), Cagampang-de Castro (law professor) and Velasquez.
Meantime, Mejia said interested parties can submit their objections to the nominees to the JBC Secretariat located at the Supreme Court in Padre Faura St., Manila or in these e-mail addresses: jbc@sc.judiciary.gov.ph; jbc87supremecourt@gmail.com.
Associate Justice Diosdado Peralta will lead the selection process for the next Chief Justice pursuant to the Supreme Court decision dated July 3 allowing a senior justice who did not apply for the position to do so.
At present, retired Supreme Court Justice Regino Hermosisima is the temporary chairperson of the JBC also composed of Senator Francis Escudero (Senate), Iloilo Representative Niel Tupas Jr. (House of Representatives), retired Court of Appeals Justice Aurora Lagman (private sector), lawyer Milagros Fernan-Cayosa (Integrated Bar of the Philippines) and Mejia (academe).
Carpio and de Lima, also members of the JBC, begged off to join the deliberations recently because they are nominees to the post.
